When do you need Low Back Pain Treatment?

Some people bear low back pain for a few days or weeks with the hope that it will pass. For some, the back pain will pass, but for the times where this is not the case, lower back pain treatment is recommended. The last thing you want is for your back pain or back injury to get worse.

Where is Your Lower Back Pain Coming From?

  • Herniated Discs: Most problems originating in the spine are a result of the spaces between the bones called intervertebral discs. These discs are composed of two main parts: a soft inner nucleus and a fibrous outer wall called the annulus fibrosis. When the fiber walls of the outer vertebrae crack, this causes the soft inner nucleus to push through and put pressure on the nerve root. This herniation of the disc can then cause pain to radiate down one or both of the legs.
  • Back Muscles: Often back pain originates from back muscles that have been strained or pulled. Those suffering from sore, aching, and painful backs are usually suffering from muscle ailments.
  • Facet Pain: Facet pain accounts for a large amount of back and neck pain in patients. Facet joints are the joints that connect each vertebra to another. Facet joints provide stability and mobility of the vertebrae. Facet pain can occur due to injury or disease and can be very painful.
  • Sacroiliac Joint Pain: Sometimes lower back pain and leg pain can be attributed to the Sacroiliac joint. The sacroiliac joint connects the spine to the pelvis and can cause pain when overused or when underused.

What is Workers’ Compensation?

Workers’ compensation is an insurance that provides cash benefits and/or medical care for workers who are injured or become ill as a direct result of their job. The cost of the insurance must be paid entirely by the employer, no amount can be charged to employees.

Under a workers’ compensation policy, employees are compensated for work-incurred illnesses or injuries, regardless of fault. In exchange, the employees are unable to sue the employer or company for any possible negligence.

The workers’ compensation system was born out of a New York state tragedy: the worst factory fire in New York City’s history, at the Triangle Shirtwaist Factory in 1911. Today, the state upholds strict requirements for employers. All New York businesses with employees (full- or part-time) must carry workers’ compensation insurance.

Workers’ Compensation claim vs personal injury claim. What is the difference?

The biggest and most important difference between a workers’ compensation claim and a personal injury claim is that a workers’ compensation claim is not based on fault, while a personal injury claim is.

Personal injury is a legal term for an injury to the body, mind or emotions, as opposed to an injury to property. Personal injury cases are most often based on the doctrine of negligence which means that personal injury lawsuits are filed against the person or entity that caused the harm through negligence, gross negligence, reckless conduct, or intentional misconduct.

In a typical slip-and-fall case, if you slipped and fell on someone else’s property it doesn’t mean that the person who owns the property (or anyone else) was negligent. Accidents, where no one is at fault, do happen.

You will not be able to sue the property owner for damages unless you and your lawyer can prove that they negligently maintained the property. The same is true in a car accident situation: you can only recover damages from the other driver if the other driver was at fault.

Fault is not required in Workers’ Compensation cases

In a workers’ compensation case, any employee injured on the job is entitled to workers’ compensation benefits, with some very limited exceptions.

In contrast to personal injury claims, workers’ compensation claims have nothing to do with fault. If you sustained an accident in the workplace, you don’t need to prove that your employer (or co-worker) was at fault. Whether they did or did not do anything wrong, you are still entitled to receive workers’ compensation benefits. Even if you were negligent yourself, and your negligence caused your injury, you will still receive the benefits.

Workers’ Compensation Patients

Within the Workers’ Compensation system, there are specific treatment guidelines at the national and at the state level that help provide the right care to the injured worker.

In some cases, they are similar, such as prescribing typical medications to treat the injured employee, but they can also differ, i.e. by indicating what is considered unsuitable therapy and what should be avoided. For this reason, the Worker’s Compensation claims are different from the average group health insurance claim.

second-opinion-1200x675.jpg

Requesting a second opinion is a common practice among patients. Unless the patient’s condition or injury is life threatening and they require an emergency care, then the patient is a perfectly good candidate for a second opinion.

Inquiring a second opinion is necessary when:

  • Surgery is said to be the only treatment available for the patient.
  • The patient suffers from a complex condition or a severe injury.
  • The patient is told that there is no treatment available to improve their condition or address the injury.
  • The patient is not comfortable with the impressions and diagnosis from the pain management doctor.
  • The patient is not given detailed and clear answers to their questions about their orthopedic injury or condition.
  • The condition returns shortly after the course of treatment.
  • The symptoms keep occurring, but the pain management doctor can’t find the cause.
  • The patient feels their condition or injury is incorrectly diagnosed.
  • The doctor does not understand why the treatment is not working.

mri-review-1200x675.jpg

Dr. Vasilios Kountis will review and interpret your MRI study and issue a detailed, informative and definitive (when possible) MRI review and second opinion report of our findings.

If requested, he will compare your MRI radiology second opinion test to previous radiology exams you’ve had.

Dr. Kountis will comment on the quality of MRI exam and recommend a repeat study if the quality is not adequate.

Based on this review, he will make a specific recommendation for a further course of action or follow up examination.

Why do I need an MRI Second Opinion?

A magnetic resonance imaging (MRI) exam is among the most powerful diagnostic tools for detecting many types of illnesses. Your doctor ordered an MRI exam because he or she wanted to make sure you had the best diagnostic care possible, leading to the best back pain treatment, if treatment is needed. An MRI second opinion is an important part of that process.

MRI images are captured by machines using enormous magnets and evaluated by radiologists. However, the interpretation of MRI results is not clear cut. The machine provides a view inside the body, but it is up to human eyes and the judgment of the treating physician to analyze what the machine has recorded and clinically correlate this findings.
